Moussa Samb ist Professor für Privatrecht und Handels-/Wirtschaftsrecht an der Universität Cheikh Anta Diop in Dakar, Senegal, und lehrt zudem “Contract Law in Africa” im Rahmen des Studienprogramms “Master of Business Law in Cross Cultural Practice” an der Universität Freiburg, Schweiz. Er war Gastprofessor an der Universität Paul Cezanne Aix-Marseille III und Senior Fulbright Scholar am Georgetown University Law Center in Washington, D.C. Professor Samb war außerdem als Senior Program Officer für den Bereich “Governance, Equity and Health” des kanadischen International Development Research Center und als Director of Research and Documentation der Organization for the Harmonization of Business Law (OHADA) in Benin tätig. Zuletzt war er Fellow am Institut d'Etudes Avancées in Nantes. Von Oktober 2015 bis März 2016 war Moussa Samb Fellow am Käte Hamburger Kolleg „Recht als Kultur“.

Forschungsprojekt

The Resurgence of Mediation as Method of Alternative Dispute Resolution for Social Conflicts in Africa

The main objective of this research focuses on mediation as an alternative dispute resolution in Africa. The research will show that the so-called “modern” African laws have failed to tap into the genius of traditional law, after the independence of African states. By a conscious and assumed mimetism, the Western law was reproduced, almost everywhere in Africa, with small reservations, ignoring traditional social control mechanisms, stored in a register of past customary law.

Yet, it is a fact in Africa, that a conflict was considered as a disturbance factor of the social order; a kind of disease that should be treated by appropriate means. In this perspective of maintaining the social status quo, the goal of returning to a peaceful situation, comes before the consideration of satisfying conflicted interests of the parties. One of the interests of promoting mediation in Africa is that it appeals more to the traditional values, and it includes a greater involvement of the parties. Mediation allows not only to overcome the disagreements between the parties but also to build new social relations, transcending future conflicts.

Our research goal is to show that in African law, the mediation procedure prevailed as the most efficient method of conflict resolution, and that the new challenge in African law is to replace the mediation as preferred way to resolve social and familial conflicts, and to build peace inside the community.
