Christa Rautenbach (Potchefstroom, Südafrika): Plurality of Marriage Laws: Exploring the Viability of a Single Marriage Code for South Africa in a Comparative Context
Abstract
In South Africa ‘unity in diversity’ is a recurring theme in public texts such as the supreme Constitution and the government’s coat of arms. At the same time, the South African Constitution promises to protect cultural rights and entitles individuals to practise and participate in the cultural life of their choice. Also, it specifically allows for the recognition of other types of ‘marriages concluded under any tradition, or a system of religious, personal or family law’. To make good on this promise of accommodation, the government enacted a plurality of laws recognising different types of relationships, and more are in the pipeline. Managing this diversity is, however, challenging, and the tension between equality and cultural rights is often visible in family law. The modest aim of this presentation is to provide a background on the plurality of marriage laws in South Africa, and the reasons why it should explore the viability of a single marriage code. In doing so, I will briefly consider the approach of a few other countries to the same question.

Prof. Dr. Christa Rautenbach ist Rechtswissenschaftlerin. Nach erfolgreichem Abschluss ihres Studiums war sie zunächst als Staatsanwältin im Dienst des südafrikanischen Justizministeriums tätig. 1994 wechselte sie als Dozentin an die North-Western-University, Potchefstroom, wo sie 2001 promoviert wurde. Von 2000 bis 2004 war Christa Rautenbach Associate Professor, bevor sie 2005 als Professorin an die juristische Fakultät der North-West-University berufen wurde. Darüber hinaus bekleidet Christa Rautenbach zahlreiche Ämter verschiedener Organisationen und Kommissionen. So ist sie unter anderem ehrenamtliche Schatzmeisterin der Society of Law Teachers of Southern Africa, Alumni und wissenschaftliche Botschafterin der Alexander von Humboldt-Stiftung sowie ehemalige Vorsitzende der Alexander von Humboldt Association of Southern Africa (North-Eastern Chapter). Ebenso ist Prof. Rautenbach Beiratsmitglied des African-German Network of Excellence in Science (AGNES). 2018 wurde Christa Rautenbach im Rahmen des Projekts „Single Marriage Statute Including Measures against Sham Marriages“ als Mitglied in den Beratungsausschuss der südafrikanischen Kommission für Gesetzesreformen berufen. Seit 2020 fungiert sie als Vorsitzende der Kommission. Frau Prof. Rautenbach ist Mitherausgeberin und Co-Autorin der in Südafrika auf ihrem Gebiet führenden Werke „Introduction to Legal Pluralism in South Africa“ und „The Law of Succession in South Africa“. Prof. Rautenbach ist des Weiteren Chefredakteurin des Potchefstroom Electronic Law Journal, sowie Beiratsmitglied verschiedener Fachzeitschriften, unter anderem des Journal of Comparative Law in Africa (Südafrika), des Journal of Civil Law Studies (Louisiana) sowie des Journal of International and Comparative Law (Großbritannien).
Seit Mitte September 2020 ist Prof. Dr. Christa Rautenbach Fellow am Käte Hamburger Kolleg „Recht als Kultur“, Bonn.
